RAPE in India

CAN YOU DEFINE RAPE?

The crime, typically committed by a man, of forcing another person to have sexual intercourse with the offender against their will.
                                                         -OXFORD DICTIONARY

                                                               -WIKIPEDIA

"I am Aswathi K H, 23 years old.I am from India. I am a fashion designer and a Psychoanalyst. My parents runs a business in Dubai. I am blessed and happy to be born as a girl and i am happy i was able to make my parents proud always. My family always stood  beside me in my ups and downs. I have my loved ones to take care of me in any situation and thats my forever strength. But as a woman AM I SAFE IN THIS WORLD? AM I SAFE AT HOME? AM I SAFE AT WORK PLACE? AM I SAFE AT PARTIES? AM I SAFE IN PUBLIC PLACES? AM I SAFE IN A BUS OR TAXI? AM SAFE AT ROADS OR ATLEST IN MY OWN BATHROOM????

WHAT IS A RAPE? From Oxford dictionary or Wikipedia surely you will get a definition and elaborate explanation about the term Rape.Theoretically at least ...

Ask a victim of Rape to define it, Probably her answer would be "DEATH".. Yes, her emotions, senses, feelings, power, strength , all dies that moment. A moment of weakness. A moment that she goes helpless and numb . A moment she is tortured with pain and lust. A moment her loud cries goes unheard. A moment that she curse herself for being born as a girl. The moment of hatred for her existence. A moment when she see herself drowning to death.

I pity the men who does this to the innocent girls/women. This is not manliness, instead he proves to be an animal who loves the flesh that satisfies his hunger. He never understands the pain that goes through his prey. He enjoys his every action with fascination. He enjoys the pleasure of getting his prey captured and showing his POWER on her. I spit on such men who try to humiliate the women in such a manner.

I am not a feminist. Nahhh not at all. I respect good men and every good thing a man does to the society. But now I'm just talking in a very ordinary persons perspective who is sooo done hearing/ reading the headlines of Rapes everyday. As a girl i feel no more secured in my own country. It scares me to even settle down there. From 2 months babies to 90+ aged  grandmas are brutally raped in our society.

Parents are selling off their daughters, using innocent girls for black magics, sacrificing girls for money and power to saints/gurus, blackmailing, Hidden camera scandals,  father is raping his own daughter, boys are gang raping the school girl, men raping and killing girls... I am terrified... WHEN THE HELL WILL ALL THIS END!!!!

We Indians  are brought up teaching the significance of women and their godly power in history and that we should respect them with full heart. Few women like me might  lack in physical strength but we are mentally stronger than any men. We should be secured in our country. The rapists has to be punished, they should be punished in the public by the people without any mercy. Then they will never dare to do it again. Others will never dare to touch a girl without her permission henceforth.

My dear brothers, A girl like me gets out in the street because we trust you and we have faith in our brothers that they won't bring harm to us,  that you brothers are there to protect us and keep us safe. But then some of you set eyes on us, follows us, comments on our body parts. Then sadly we girls become the hot topic for your boys group discussions. And then one fine evening you Brother attack us in the dark.........Y?Y?Y?  Brother, we may seem hot, sexy, or attractive to you. That does not mean you can touch us without our permission.

We have the right to wear what we like. If exposing your boxers and ass and almost every part of your body to the world isn't a crime then what we wear is definitely not a crime at all. But you and the society find it the best reason to blame the victim. I am soo done with that lame reasoning. Infact 90 percent of the Rape cases that reported in India, the victims were either wearing saree, salwar kameez or uniforms which are considered as the most decent clothing in our country. So its definitely not about the clothes, ITS ABOUT THE THINKING.

We are an average middle class women who are independent, working, earning money for ourselves and our families. There are kids who needs to go to nurseries and girls who needs to go to schools and colleges and there are aged women who need to go out to buy groceries or to see doctors for regular checkups. There are pregnant women, there are beggars  there are mentally retarded women out there. We are just ordinary human beings. We are not super woman. We all have our own daily activities to do, we have our own lives to live..But now we are even scared to set our feet outside the home. How long shall we live in this fear! Yea most of us are handy and cannot fight your physical strength but  WE CANNOT SIT AT HOME IDLE FEARING YOU. WE TOO DESERVE THE RESPECT WHICH WE ALWAYS GAVE YOU. HE HAVE THE RIGHT TO LIVE OUR LIVES PEACEFULLY.

They dont leave anyone- Small babies, school children, married women, pregnant women, nuns, mothers, grandmas, college girls and even dead bodies. They can do anything to anyone for their pleasure,They can kill and find their pleasure, they hurt them to the extreme to find the pleasure in their screams.
They are no less than any wild beast. They are the real evil, they are the real satan.

I know nobody can bring a sudden change in our society but please stop doing harm to the women. For those who Rape a girl its just a matter of POWER AND PLEASURE. But the victim cannot forget that nightmare so easily. She will forget the feeling of trust towards any man. If any of you think an incident of half and hour or 1 hour cannot do harm to any girl and its easily forgettable, IT IS NOT. It is that deep. It is that painful. It is that shattering. Imagine your mom or sister or wife in that victims shoes and try to feel what she would have gone through. Yes indeed its a DEATH. A death that follows her mind till her last breath.

Coming to men, I dont even feel men are safe in this world now. There are many reports that shows small boys  are forced to have sex with men. These animals just need flesh- doesn't apply whether it has to be a girl or a boy. If a day comes, they dont find a female in this world, definitely they will start preying on the men/ boys.

conclusion-
If she ever say NO then thats a NO. She don't belong to you, her body doesn't belong to u. So keep your eyes off her and do not dare to touch what is not yours.
If you ever come across a rape victim, never question her about the incident. Let her move on. If she managed to survive from it, encourage her to continue her life like an ordinary person. Pass positive vibes to her. After all , She is a survivor.
Teach your sons and brothers how important and pure a woman is. Teach them to respect women. Let the good change begin from our home. We mankind is gods best creation so far. Lets share and care each other. Lets don't harm our siblings. Lets live like a pure human in this planet. We sisters need our brothers back. We want our safety back. We need our lives back....Stay safe everyone. "

                                                                                                                      -Aswathi KH

According to 2012 statistics, New Delhi has the highest raw number of rape reports among Indian cities, while Jabalpur has the highest per capita rate of rape reports. Several rape cases in India received widespread media attention and triggered protests since 2012. This led the Government of India to reform its penal code for crimes of rape and sexual assault.

    RAPE OF MINORS

ESTIMATES OF UNREPORTED CASES
Most rapes go unreported because the rape victims fear retaliation and humiliation, both in India and throughout the world.Indian parliamentarians have stated that the rape problem in India is being underestimated because a large number of cases are not reported, even though more victims are increasingly coming out and reporting rape and sexual assaults.According to an estimate from 2014, only 5-6% of rape cases in India are reported to the police
Few states in India have tried to estimate or survey unreported cases sexual assault. The estimates for unreported rapes in India vary widely. A comparison between data from the National Crime Records Bureau (NCRB) and the National Family Health Survey (NFHS) in 2005 shows that 5.8% of rapes by men other than the victim's husband was reported, and 0.6% of rapes by the husband were reported.Madiha Kark estimates 54% of rape crimes are unreported.A UN study of 57 countries estimates just 11% of rape and sexual assault cases worldwide are ever reported.

NOTABLE INCIDENTS

-The gang rape of a 23 year old student in a public biso on 16 th December 2012,sparked large protests across the capital Delhi. She was with a male friend who was severely beaten with a iron rod  during the incident. This same rod was used to penetrate her so severely  that the victim's intestines had to be surgically removed, before her death 13 days after the  attack.
-In August 2013, a 22-year-old photojournalist, who was interning with an English-language magazine in Mumbai, was gang-raped by five persons, including a juvenile, when she had gone to the deserted Shakti Mills compound, near Mahalaxmi in South Mumbai, with a male colleague on an assignment. This caused protests throughout the country since Mumbai with its very active nightlife was previously considered a safe haven for women. The city sessions court found the accused guilty and sentenced death penalty to the three repeat offenders in the Shakti Mills gang rape case, making them the first in the country to get the death sentence stipulated under the newly enacted Section 376E of the Indian Penal Code.
-In May 2014 two girls aged 14 and 16 were allegedly gang raped and murdered in the northern state of Uttar Pradesh, though later investigations have alleged suicide as the cause of death in this instance. Two police officers were suspected of involvement in the crimes. The alleged gang rape was widely reported in the press both in India and globally. After an extensive investigation, the CBI concluded that the rape and murder allegations were false.
-On 14 March 2015, a 71-year-old nun was allegedly gang-raped in Ranaghat, West Bengal by intruders at Convent of Jesus and Mary. The six intruders were recorded on CCTV during their crime of ransacking the chapel, destroying religious items, looting cash and the gang rape. Six men were arrested and charged with the crime by 1 April 2015, and identified to be BangladeshiMuslims.
-On 29 March 2016, the corpse of Delta Meghwal, a 17 year old Dalit girl, was found in her hostel's water tank. Following the registration of the police case the hostel warden, physical education teacher and principal were arrested by Bikaner police and kept under judicial custody. The State eventually acceded to a CBI inquiry after the issue became politicised.

-During the partition of India, some 100,000 women claimed to have been kidnapped and raped.

CONVICTIONS

The conviction rate for rapes has fallen at a steep rate over the past 40 years. The conviction rates for Rape cases in India were 44.3 percent in 1973, 37.7 percent in 1983, 26.9 percent in 2009, 26.6 percent in 2010, 26.4 percent in 2011, 24.2% in 2012 and 27.1% in 2013.

India’s conviction rate is higher than developed countries, such as the United Kingdom, which recorded a conviction rate of 7% in 2011-12. The conviction rate as low as 10% in Sweden and 25% in France.

                                                                     Fast track courts
As a result of the 2012 Delhi gang rape case, the Indian government implemented a fast-track court system to rapidly prosecute rape cases. The fast-track court system has been welcomed by some, but their fairness questioned by legal experts and scholars. The legal scholars state that the fast-track courts may not be fair in an impoverished country where millions of cases are backlogged, and there are an average of just 14 judges per million people - among the lowest in a United Nations study of 65 nations.Fast track courts divert limited judicial resources and add delays to prosecution of other crimes. They noted that Delhi state had instituted five fast-track courts in 2013 to handle rape cases, but there are no fast-track courts for murder.Mrinal Satish, of New Delhi's National Law University said, "there is a risk that in this emotional response and clamor for immediate justice, we could end up putting innocent people in prison".

POTENTIAL ABUSE CONCERNS

In April 2013, Judge Virender Bhat has suggested that the legal proposition of relying upon the sole attestation of the victim became "an easy weapon" to incriminate anyone in rape case.Justice Kailash Ghambhir of the Delhi High Court stated that penal provisions for rape are often being misused by women as a "weapon for vengeance and vendetta" to harass and blackmail their male friends by filing false cases to extort money and to force them get married. Saamna, mouthpiece of Shiv Sena in an editorial noted while supporting the Deputy Inspector General Of Police in Mumbai in an alleged rape complaint that it has become "a fashion to create sensation by charging someone for rape and molestation" while Shonee Kapoor, founder of Sahodar Men's Right Group, demanded that the name of the accused should not be made public till conviction.

EDUCATION PROGRAMMES

In February 2017, the Ministry of Health and Family Welfare unveiled resource material relating to health issues to be used as a part of a nationwide adolescent peer-education plan called Saathiya. Among other subjects, the material discusses relationships and consent. The material states, "Yes, adolescents frequently fall in love. They can feel attraction for a friend or any individual of the same or opposite sex. It is normal to have special feelings for someone. It is important for adolescents to understand that such relationships are based on mutual consent, trust, transparency and respect. It is alright to talk about such feelings to the person for whom you have them but always in a respectful manner. ... Boys should understand that when a girl says 'no' it means no."
